Obvious Elevator Defect

Tenants complained of a reduction in services based on an elevator defect. The DRA ruled for tenants. Landlord appealed, claiming that there were no DOB elevator violations and that the DHCR should leave any elevator complaints to that agency. The DHCR ruled against landlord. The DHCR will leave technical elevator issues that it can't determine to the expertise of DOB. But an inspection showed that, at every floor, the elevator stopped two inches above or below the floor level. This was such an obvious defect that a rent reduction was warranted.
