Elevator Was Defective

Tenant complained of a reduction in building-wide services based on defective elevator service. The DRA ruled for tenant. Landlord appealed and lost. Landlord claimed that the elevator service was not defective. The landing was within three feet of the floor level of the elevator when opened. This was acceptable under DOB regulations. The DHCR inspection showed that none of the building's elevators stopped level with the landing when opened. Gaps ranged between one inch and three and one-half inches too low on either ascent or descent. All of the elevators jerked when they stopped.

The rents also had been reduced because of soot in the stairwells, and dirty walls with peeling and blistered paint.
