Rent Reduction Based on HPD Heat Violation

Rent-stabilized tenant complained of insufficient heat in his apartment. The DRA ruled for tenant based on two HPD heat violations at the building, and reduced his rent. Landlord appealed and lost. Landlord argued that the HPD violations applied to a different apartment at the building. But the HPD violations indicated that there was inadequate heat in the whole building. The HPD violation was based on either a boiler inspection or inspection of a number of apartments.
