New Security System

Tenant complained of a rent overcharge. Landlord submitted proof that before tenant moved in, he installed a new security lock system, including wrought-iron window gates. The DRA ruled for tenant and disallowed any rent increase for the new equipment. Landlord appealed. Tenant had consented to the rent increase in a vacancy lease rider. The DHCR ruled for landlord. The new security system was an apartment improvement installed during a vacancy. Landlord was entitled to a rent increase, and no tenant consent was required. The permissible monthly rent increase was $35, equal to 1/40th of the $1,400 cost. There was no rent overcharge.
