Landlord Provided Enough Garbage Cans

LVT Number: 12482

Tenants complained of a reduction in building-wide services, claiming that no garbage cans were provided. The DRA ruled for tenants and reduced their rents. Landlord later applied for rent restoration. The DRA ruled for landlord after an inspection showed that garbage cans were being provided. Tenants appealed, claiming that landlord provided only two garbage cans for the 24-unit building when DOS rules required at least six cans, or one can for every four apartments. The DHCR ruled against tenants.

The DHCR ruled against tenants. The DRA's order didn't say how many garbage cans landlord should provide or where they should be located. There was no claim that the area where the garbage cans were located was dirty or that trash overflowed. Any complaint about a violation of DOS rules should be brought before that city agency.
