Discontinued TV Antenna Was Minor Condition

Tenants complained of a reduction in apartment services, including a TV antenna and antenna jack. Landlord claimed that this wasn’t a required service. The DRA ruled for tenants and reduced their rent. Landlord appealed and won. Landlord hadn’t provided TV antenna service to tenants’ apartment for more than four years. In fact, tenants moved into the apartment in 1974 and the TV antenna service was discontinued shortly thereafter. It was therefore a de minimis condition that didn’t warrant a rent reduction.
