Only Minor Conditions Found

Tenants complained of a reduction in building-wide services based on a number of conditions. The DRA ruled for tenants, and landlord appealed, claiming that most of the conditions complained of were minor as defined by the DHCR's 1995 memo and didn't warrant a rent reduction. The DHCR ruled for landlord. The claimed conditions that were found to exist were all minor. They included sidewalk cracks that didn't cause tripping hazards, minor masonry deterioration, minor areas of peeling paint or plaster, and floor saddling. The rent reductions were revoked.
