Tenant complained of a rent overcharge. Landlord claimed that the apartment was renovated extensively before tenant moved in. The DRA ruled for tenant and disallowed some of the 1/40th improvement costs submitted by landlord. Landlord appealed and won. Landlord showed that it spent $5,000 on bathroom renovations. Tenant claimed that landlord left original tiles in the bathroom but submitted no proof that work wasn't done. Landlord submitted invoices, checks, and photographs documenting the bathroom renovation work.
