New Bathtub and Bathroom Tiles

Tenant complained of a rent overcharge. The DRA ruled for tenant. Landlord appealed, claiming that the DRA improperly disallowed a 1/40th rent increase for bathroom improvements made before tenant moved in. The DHCR ruled for landlord in part. Tenant admitted that a new bathtub and tiles were installed in the bathroom. But landlord's friend, and tenant himself, did the installation work. The DHCR allowed some of landlord's costs, but disallowed any labor costs. As a result, it lowered the overcharge finding from $15,000 to $11,000.
