Vermin, Cracks, Defective Bathtub Caulking Not De Minimis

Tenant complained of a reduction in services. The DRA ruled for tenant. The DRA found that landlord wasn't maintaining vermin control, didn't caulk the bathroom tub in a workmanlike manner, and that there were hairline cracks on the walls and ceilings after landlord painted the apartment. Landlord appealed, claiming that these were all minor conditions. The DHCR ruled against landlord. Failure to correct a systemic vermin problem is a threat to health. Hairline cracks on ceilings and walls can lead to progressive deterioration of the paint and plaster. Unworkmanlike caulking around the tub can lead to flooding and tile deterioration. These weren't minor conditions.
