Reduced Super Service

Tenants complained of a reduction in building-wide services. They claimed that landlord didn't provide a full-time super-intendent. Landlord claimed that a super lived in an adjoining building, was available on a 24-hour basis, and provided all required maintenance services for the building. The DRA found no grounds for a rent cut, but ordered landlord to maintain a sign with the super's name, address, and phone number in the building lobby. One tenant appealed. The DHCR ruled against tenant.

Landlord claimed that a super lived in an adjoining building, was available on a 24-hour basis, and provided all required maintenance services for the building. The DRA found no grounds for a rent cut, but ordered landlord to maintain a sign with the super's name, address, and phone number in the building lobby. One tenant appealed. The DHCR ruled against tenant. A reduction in building personnel isn't in itself a decrease in services unless it's shown that there's also been a decrease in building maintenance. Although tenants claimed the super couldn't be reached in the event of an emergency and wasn't on the premises full time, they didn't claim there were specific building conditions requiring correction.
