Basement Access Reduced

Tenants complained of a reduction in building-wide services. The DRA ruled for tenants based on landlord's denial of 24-hour access to the basement storage area. Landlord appealed. Landlord argued that 24-hour access wasn't required by lease provision or the rent stabilization code and that basement hours were reduced for legitimate security reasons. The DHCR ruled against landlord. There was no question that tenants previously had 24-hour access to basement storage facilities.

While landlord should take reasonable steps to ensure the building's security, it can't reduce a provided service without approval from the DHCR.
