Recycling Material Stored in Incinerator Room

LVT Number: 11800

Tenants complained of a reduction in building-wide services, claiming improper storage of garbage. The DRA ruled for tenants, and landlord appealed. An inspection showed that plastic bottles, cans, newspapers, and cardboard boxes were collected in the incinerator room for recycling. This, in and of itself, wasn't a decrease in service. And there was no proof of any vermin or offensive odors as tenants had claimed. The DHCR ruled for landlord and revoked the rent reductions.
