Landlord Provided Adequate Substitute for Incinerator

Tenants complained of a reduction in services. The DRA ruled for tenants and reduced their rents based on a finding that landlord had sealed off incinerator rooms. Landlord appealed, arguing that the incinerators were eliminated to comply with local law and that the inspector had noted that adequate facilities were being provided. The DHCR ruled for landlord. Tenants now carried garbage downstairs to a sufficient number of courtyard garbage containers. This was an adequate substitute service.
