Public Area Lighting Controlled by Pull Switch

Tenant complained of a reduction in building-wide services. Tenant claimed that the lobby front area was inadequately lit. The DRA ruled for tenant. Landlord appealed and lost. An inspection showed that a wall light fixture in the lobby worked by a pull switch, the area was dark when the inspector arrived, and the building vestibule also was inadequately lit. Landlord claimed that there was sufficient light from windows and that the lights were on timers from 4 PM to 8 AM. The DHCR ruled that the DRA had reasonably relied on its inspector's report.
