Building's Public Area Conditions Weren't Minor

Rent-stabilized tenants complained of a reduction in building-wide services. The DRA ruled for tenants and reduced their rents. Landlord appealed and lost. Landlord claimed that the cited conditions were de minimis--that is, minor. But DHCR inspection showed that the lobby was dusty, the lobby floor carpeting was stained, the fourth-floor carpeting was stained and had splotches of paint, and the floors and stairs throughout the building were dirty, dusty, stained, and in need of cleaning.

There also were brown leak stains on the top floor; peeling paint, plaster, and stains on the fourth-floor ceiling; and stains on the second-floor wall. Together, these weren't minor conditions and they showed that janitorial service was deficient.
