PAR Not Filed on DHCR Form

Tenant complained of a rent overcharge. The DRA ruled for tenant, and landlord appealed. Landlord submitted a letter to the DHCR stating that the letter served as landlord's PAR. Landlord's attorney later submitted a PAR on the proper PAR form. The DHCR ruled against landlord and dismissed the PAR. The PAR form was filed after the 35-day legal deadline for doing so. And landlord's letter, while filed within 35 days, wasn't a properly filed PAR. The Tenant Protection Regulations state that a PAR may be filed only on a form designated by the DHCR for that purpose.
