Landlord Must Refile PAR on DHCR Form

Landlord filed a petition for administrative review (PAR) against a DRA order that granted tenant a rent reduction based on a reduction in required services. The DHCR rejected landlord’s PAR. Operational Bulletin 84-1 requires that PARs be filed on DHCR Form RAR-2. But the DHCR gave landlord 35 days to refile the PAR on the proper form. If landlord failed to refile within 35 days, it would have no further opportunity to do so.
