No Reduction in Building-Wide Security Services

Rent-stabilized tenants complained of a reduction in building-wide services. They claimed that building security services were substantially reduced after landlord installed a new video security system. Tenants said that for 20 to 25 years, landlord had security patrols and on-site camera monitoring 24 hours, seven days a week. But recently, the service was contracted out, the security staff was cut in half, there were fewer guards patrolling, and the camera monitor was off-site.

Rent-stabilized tenants complained of a reduction in building-wide services. They claimed that building security services were substantially reduced after landlord installed a new video security system. Tenants said that for 20 to 25 years, landlord had security patrols and on-site camera monitoring 24 hours, seven days a week. But recently, the service was contracted out, the security staff was cut in half, there were fewer guards patrolling, and the camera monitor was off-site. Landlord argued that the security service was in fact increased by the changes because now professionals were employed, that personnel patroled at least 280 hours per week, and the new video security system enhanced building security. The DRA ruled against tenants, who appealed and lost. Landlord had submitted payroll records at the DRA's request, which showed that 264 hours of security service was provided in 2007, and 282 hours in 2008. Two or three guards were on patrol at all times. There was no showing of any reduction in building security services.
