No Building-Wide Rent Cut for Leaks in Two Apartments

A number of tenants complained of a reduction in buildingwide services based on water leaks. An inspection showed water leaks in two top-floor apartments. The DRA ruled for all complaining tenants and reduced their rents. Landlord appealed, arguing that only tenants who had water damage should receive rent cuts. The DHCR ruled for landlord. There were no conditions warranting rent cuts for anyone other than the two tenants with confirmed water damage. The rent cuts for the other tenants were revoked.
