No Notice to Landlord Required for Apartment Inspection

Rent-stabilized tenant complained of a reduction in required services. The DRA ruled for tenant, reduced his rent, and directed landlord to restore services. Landlord appealed and lost. Landlord claimed that it wasn't given notice of DHCR inspection until too late and therefore was denied due process. DHCR inspections conducted while the case was before the DRA showed that the kitchen floor, living room floor, and hallway floor were uneven and created a potential safety hazard because there were trip hazards present.

DHCR inspections conducted while the case was before the DRA showed that the kitchen floor, living room floor, and hallway floor were uneven and created a potential safety hazard because there were trip hazards present. There also were unworkmanlike repairs and uneven flooring in a bedroom, another trip hazard. Inspection of an individual apartment doesn't require that the DRA notify landlord unless the inspection was a "no access" inspection. The inspection conducted here wasn't a no-access inspection.
