Landlord Claims Notice Listed Incorrect Apartment Number

Tenant complained of a reduction in services. The DRA ruled for tenant and reduced her rent. Landlord appealed. The DRA's notice of tenant's complaint stated that tenant's apartment was 6C. Landlord made repairs to that apartment. In fact, however, the complaining tenant lived in apartment 6G and repairs weren't made there. Landlord argued that it was the DRA's fault, based on its mistaken notice. The DHCR ruled against landlord.

Landlord made repairs to that apartment. In fact, however, the complaining tenant lived in apartment 6G and repairs weren't made there. Landlord argued that it was the DRA's fault, based on its mistaken notice. The DHCR ruled against landlord. Even if the apartment number was wrong on the cover notice, the DRA sent landlord a copy of tenant's complaint, with tenant's name, correct apartment number, and the conditions in question. Landlord had sufficient notice to have been able to make proper repairs.
