Landlord Proved Fuel Cost Report Mailed to Tenants

Landlord appealed a DRA order that suspended 2002 fuel cost adjustments. The DRA found that landlord hadn't timely filed a 2002 report of fuel price decrease. Landlord submitted a copy of its 2002 report date-stamped by the DHCR on April 17, 2002. The DHCR ruled for landlord. Landlord proved that the report was filed with the DHCR, and also submitted a copy of proof of mailing to tenants with a U.S. Post Office form listing all rent-controlled tenants and date-stamped on April 16, 2002.
