Landlord Filed Proper Fuel Cost Adjustment Report

Rent-controlled tenant challenged landlord’s 2008 fuel cost adjustment report. The DRA ruled for tenant in part. Landlord’s report was found accurate, but landlord was charging tenant $63.75 for fuel when he should charge $56.22. Landlord was ordered to correct this error. Tenant appealed, again claiming that landlord shouldn’t get any fuel cost adjustment. Tenant claimed that there was no gas for four months. The DHCR ruled against tenant.

There was no false certification of fuel costs, and no outstanding DHCR order finding any reduction in services.
