Landlord Proved Fuel Cost Report Filed on Time

The DRA suspended landlord's fuel cost adjustment for 1999 because landlord had previously gotten a fuel cost increase and hadn't filed a 1999 report of a fuel price decrease. Landlord appealed, claiming that he had filed the report. The DHCR ruled for landlord. A review of the DHCR's records showed that landlord had filed the report on time. It was missing from the DRA's file at the time that the fuel cost adjustment was suspended.
