Landlord Mistakenly Signed 'Certification A'

Tenant filed a challenge to landlord's 2003 fuel cost report. Tenant claimed that landlord improperly signed ''Certification A'' to the fuel cost report, which stated that the maximum collectible rent plus the cumulative fuel cost adjustment wasn't greater than the MBR plus other related amounts. The DRA ruled against tenant, finding that the MBR wasn't an issue. Tenant appealed and lost. Landlord shouldn't have signed ''Certification A.'' But there were no other errors in the fuel cost report. Landlord's mistakenly signing was a harmless error.
