Landlord Gets Fuel Cost Adjustment

The DRA suspended fuel cost adjustments for landlord's building for 2004. The DRA found that landlord previously got a fuel cost rent increase and failed to timely file a 2004 report of a fuel price decrease. Landlord appealed, claiming that the 2004 report was timely filed. The DHCR ruled for landlord. Landlord proved that it had filed the 2004 fuel cost decrease report by showing a date-stamped copy of what it had submitted to the DRA.
