Landlord Misstated Room Count

Landlord applied for a fuel cost adjustment from rent-controlled tenant. The DRA ruled for landlord. Tenant appealed, claiming that landlord's application contained a false room count. Tenant said that the DHCR had warned landlord about this in a prior year's order. The DHCR ruled for tenant. Landlord stated that tenant's apartment had two rooms, but it had only one room. Landlord was warned by the DHCR in 2004 that false certification could result in sanctions. So the DHCR revoked the fuel cost adjustment and ruled that landlord couldn't collect any fuel cost adjustment for two years.
