Incinerator Rooms in Acceptable Condition

The DRA ruled for tenants and reduced their rents. Landlord later applied for rent restoration based on restoration of services. The DRA ruled for landlord, and tenants appealed. They claimed that the incinerator rooms of the building were still very dirty and that all six of them should have been inspected. The DHCR ruled against tenants.

An inspection of three of the incinerator rooms showed that they were clean. The DHCR's random inspection of some of the incinerator rooms was customary and indicated compliance with the DRA's order.
