Gates and Fences Unrelated to CCTV Security System

The DRA granted landlord’s application for MCI rent hikes based on the installation of a CCTV/security system and coaxial cables for the elevator, but denied any increase for a parking lot fence and gate, and basement fence and gate. Landlord appealed and lost. Landlord claimed in its PAR that the other work was required and directly related to the CCTV/security system installation. In its MCI application, landlord listed the fences and gates as separate MCI improvements.

Landlord appealed and lost. Landlord claimed in its PAR that the other work was required and directly related to the CCTV/security system installation. In its MCI application, landlord listed the fences and gates as separate MCI improvements. By themselves, they didn’t qualify as MCIs, and, while they may improve security at the building, these installations weren’t necessary or related to the CCTV/security system installation.
