MCI Increase Granted for Installation of CCTV Security System

Landlord applied for MCI rent hikes based on installation of a CCTV security system. The DRA ruled for landlord. Tenants appealed and lost. It's long-standing DHCR policy that installation of a CCTV security system qualifies as an MCI, provided the system monitors all entrances to the building on a continuous basis. Landlord's system was accessible and monitored the building 24 hours, seven days per week. The CCTV system wasn't part of a key fob/keycard system approved by the DHCR in a separate proceeding.

Landlord's system was accessible and monitored the building 24 hours, seven days per week. The CCTV system wasn't part of a key fob/keycard system approved by the DHCR in a separate proceeding. The DRA's order in that proceeding didn't require live, in-person monitoring of the CCTV system 24/7. It required the system to continuously monitor all entrances to the building. By its presence, the CCTV security system acted as a deterrent to intruders. Landlord's timely MCI application based on this work was filed within two years of completion of the installation.
