Tenant complained of a rent overcharge. The DRA ruled against tenant, finding no overcharge. Tenant appealed. He questioned landlord's proof of 1/40th improvements. The DHCR ruled against tenant. Landlord submitted an invoice for electrical work and a light fixture that was dated at the same time that the work was done. Landlord wasn't required to get the lowest cost for the work. The checks and receipts accompanied by the invoice and an affidavit from the contractor were sufficient proof of payment of the claimed cost. The payments equaled the amount claimed for the work.
