Defect in One Public Area Window Warranted Rent Reduction

Rent-stabilized tenants complained of a reduction in building-wide services based on a decrease in services to the security cameras and the windows. The DRA ruled for tenants and reduced their rents. Landlord appealed and lost. Landlord argued that the finding by the DHCR's inspector concerning one window in the public hall staircase didn't constitute a reduction in services. But landlord didn't dispute that the window sash slid down on this window.

Landlord appealed and lost. Landlord argued that the finding by the DHCR's inspector concerning one window in the public hall staircase didn't constitute a reduction in services. But landlord didn't dispute that the window sash slid down on this window. And the inspector's finding that one of the security cameras, at the vestibule door, was inoperative at the time of inspection was confirmed by photographs of the security camera system throughout the building that were time- and date-stamped and included in the inspector's report.
