Circuit Breaker Not Working

Rent-stabilized tenant complained of a reduction in services because the circuit breaker to her apartment didn’t work. The DRA ruled for tenant and reduced her rent. Landlord appealed and lost. Landlord claimed that there was no circuit breaker to tenant’s apartment.

Rent-stabilized tenant complained of a reduction in services because the circuit breaker to her apartment didn’t work. The DRA ruled for tenant and reduced her rent. Landlord appealed and lost. Landlord claimed that there was no circuit breaker to tenant’s apartment. But when landlord’s managing agent answered the complaint, he wrote to the DRA that each apartment had its own circuit panel and that the main circuit switch was sometimes tripped when overloaded. The DHCR’s inspector also found four circuit breakers in the building basement. Two of them weren’t working.
