No MCI Increase for Circuit Breakers

The DRA denied landlord's MCI rent increase application based on the installation of new circuit breakers. Landlord appealed and lost. Landlord claimed that it installed an eight-circuit panel box and GFI protection for all bathrooms in the building and that 17 apartments also received GFI receptacles.

The DRA denied landlord's MCI rent increase application based on the installation of new circuit breakers. Landlord appealed and lost. Landlord claimed that it installed an eight-circuit panel box and GFI protection for all bathrooms in the building and that 17 apartments also received GFI receptacles. But, to qualify as an MCI, electrical upgrading requires the installation of new electric services to the building, and new copper risers and feeders that extend from the property box in the basement to every apartment of sufficient capacity at the apartment panel to accommodate the installation of conditioner circuits and outlets, as well as the installation of two double outlets in the kitchen to accommodate heavy-duty appliances.
