Boiler Room Door Opens Away from Egress Direction

LVT Number: 18935

DOB issued a violation notice to landlord for not maintaining its boiler in a safe condition. The inspector noted that the boiler room door opened away from the direction of egress. City regulations required a boiler room to open in the direction of egress. Landlord argued that this didn't mean the boiler room wasn't kept in a safe condition. The ALJ ruled against landlord and fined it $350. Landlord appealed and lost. The New York State Industrial Code supported DOB's finding. On the other hand, landlord presented no authority for its position that the boiler room door was safe.
