Apartment Door Wasn't Defective

Tenant complained of a reduction in services. Tenant claimed that her apartment door was defective because there were three missing “bumpers” from the apartment door frame, and there was a gap between the door and door frame that allowed light and cold to filter through. The DRA ruled against tenant after DHCR inspection found no conditions requiring repair. Tenant appealed and lost. DHCR inspection found that the door opened, closed, and locked properly and that the door was secure.

The conditions cited by tenant didn’t affect the closing and locking of the apartment entrance door. But landlord should fix these conditions as they may be grounds for a new complaint.
