Violation Notice Incorrectly Identified Address

The DOB issued a violation notice to landlord for not maintaining an elevator in a safe condition. Landlord pointed out that the address on the violation notice wasn't the correct address of its building. The ALJ dismissed the violation notice because it didn't accurately set forth the place where the violation had occurred. The DOB appealed, pointing out that the building had three addresses. The ECB ruled that the DOB couldn't change its position now. The ECB had agreed to the dismissal when the case went before the ALJ.
