Tenant filed a fair market rent appeal. In setting the fair market rent, the DRA gave landlord a rent increase for replacing the terrace deck outside tenant's apartment. Tenant appealed, claiming that the ``terrace replacement'' was actually reroofing and tile and drain replacement for which no rent increase was warranted. The DHCR ruled against tenant. Landlord proved that it provided tenant with a replacement terrace and that it was entitled to a rent increase for that installation.
