Landlord sued to evict rent-stabilized tenant for creating a nuisance. Tenant claimed that landlord's termination notice didn't sufficiently describe the reasons for landlord's claim. The court ruled for tenant and dismissed the case without a trial. Landlord appealed and won. The termination notice stated that tenant had caused extensive water damage to his own apartment on at least two specified occasions, that tenant had also caused serious damage to the apartment below, that tenant didn't provide landlord with access to repair the damage, and that tenant's conduct violated specific sections of the Rent Stabilization Code. Landlord's termination notice sufficiently notified tenant of the reasons landlord sought tenant's eviction.
