Tenants Didn't Ask for Rent Cut

Tenants complained of a reduction in building-wide services. An inspection showed that the complained-of conditions existed. The DRA ordered landlord to make repairs, and reduced tenants' rents. Landlord appealed, pointing out that tenants didn't request rent cuts. The DHCR found that rent-stabilized tenants' complaint form indicated that no rent cut was sought ``at this time.'' So, the rent cuts for the stabilized tenants were revoked because the Rent Stabilization Code gives tenants the option of requesting rent cuts for reduced services. However, under rent control regulations, the DRA decides if the service reductions warrant rent cuts. So, rent cuts for rent-controlled tenants remained in effect.
