Tenant's Apartment Flooded from Laundry Machine in Upstairs Apartment

Tenant complained of a reduction of required services. Her apartment had been flooded on a number of occasions by upstairs tenant's overflowing washing machine. The DRA ruled against tenant because she had received a rent abatement in court for this condition. Tenant appealed, arguing that the condition continued and that the DHCR had conducted no inspection. The DHCR ruled for tenant and reduced her rent. Tenant showed that the condition continued on a number of occasions. Among other things, tenant submitted a videotape documenting the condition.
