Apartment Damaged by Flood

Tenant complained of reduced services in her apartment, claiming that her walls, floors, and ceilings were damaged by a flood. Landlord claimed that he'd made all repairs except for the painting, which, he said, tenant wanted to do herself. A DHCR inspector reported that one of the ceilings was rusted and another one also needed repair. The DRA cut tenant's rent, and landlord appealed. Landlord argued that the inspector's findings had nothing to do with tenant's complaint. The DHCR upheld the rent cut. Tenant's complaint that her ceilings had been damaged by a flood was consistent with the inspector's findings, so the rent cut is proper.
