Tenant Waited Too Long to Complain

Tenant appealed, claiming that the number of benches was reduced from 46 to 15 outside the building complex after 1989 and that a storage and package room was eliminated in 1984. The DHCR ruled against tenant. Under the Rent Stabilization Code, if a tenant waits more than four years to complain about a reduction in services, the condition is presumed to be minor. Here, tenant waited too long to complain about these conditions, so they were deemed minor.
