Tenant Paid Rent Due

Landlord sued to evict tenant for nonpayment of rent. The court ruled for landlord. Execution of the eviction warrant was delayed while tenant was given a chance to pay the back rent owed. Landlord later asked the court to proceed with the eviction. The court ruled against landlord, and landlord appealed and lost. Landlord agreed, by stipulation, to delay eviction and to extend tenant's lease for one year if the $8,000 back rent was paid. During this period, tenant paid use and occupancy while seeking emergency rent assistance from DSS.
