Tenant Needed Ladder to Open Windows

Tenant complained of a reduction in services. She claimed she couldn't open or close the top window sash without a stepladder. Tenant was a senior citizen. The DRA ruled for tenant based on ``window sash/frame'' defects. Landlord appealed and won. The fact that the window sashes couldn't be opened without the use of a ladder didn't make the windows defective. The DHCR revoked the $16 monthly rent reduction for this condition.
