Windows Were Difficult to Open

Tenant complained of reduced services. He claimed that new windows installed by landlord were difficult to open. Landlord claimed that the new thermal break tilt windows were in good working order and that minor adjustments were made as needed. An inspection showed that one living room window top sash and the bathroom window top sash were hard to open. The DHCR ordered landlord to adjust the windows, but didn't reduce tenant's rent. Tenant appealed. The DHCR ruled against tenant. Based on the inspection, the DRA found that a rent reduction wasn't warranted. This was reasonable.
