Tenant-Installed Air Conditioner

Landlord applied to the DHCR for a $5 per month rent hike based on tenant's installation of an air conditioner. The DRA granted landlord's application, and tenant appealed. Tenant claimed that the air conditioner had been installed 12 years before, that the unit didn't extend beyond the building line, and that the DHCR had never inspected his apartment. The DHCR ruled for landlord. DHCR inspectors had made two attempts to inspect, and couldn't get access.

Since tenant didn't cooperate with the DHCR's investigation, he can't dispute landlord's claim to a $5 per month rent increase for the air conditioner.
