Tenant Defaulted Under Settlement Agreement

LVT Number: 6854

Landlord sued to evict tenant for nonpayment of rent. Landlord and tenant agreed in court that tenant would pay rent arrears. Tenant defaulted on the payment schedule agreed upon. The trial court gave tenant more time to pay, and landlord appealed. The appeals court ruled that the lower court properly gave tenant more time to pay. Tenant had lived in the rent-stabilized apartment 14 years and his default wasn't substantial.
