Landlord sued to evict tenant building superintendent after she was fired from her position. The trial court ruled for landlord and tenant appealed. Tenant had filed a complaint with the NYC Human Rights Commission claiming gender discrimination. The appeals court reversed and ruled that no decision should be made on the eviction case until tenant's discrimination claim was decided. If that case was decided in tenant's favor, she would have to be reinstated in her job and couldn't be evicted.
